Edward Hales, a Roman Catholic, was convicted of not swearing an oath of supremacy upon entering the army. Chief Justice Edward Herbert ruled that James II had the right to overrule any of the penal laws, including Hales conviction, if he saw fit. "William Atwood examined Herbert's vindication with much learning and ability." DNB IX, p. 634. Atwood would later become the Chief Justice of the Court of Admiralty in the province of New York.
