Robert Stern was acting solicitor general of the United States during part of 1952 and part of 1953. He had worked in the United States Department of Justice from 1933 to 1953 and argued over 55 cases before the United States Supreme Court. In 1950, he wrote this work at the urging of several justices of the Supreme Court who were dissatisfied with the quality of legal briefs in Supreme Court cases at that time.
