Robert Atkyns was a judge on the Court of Common Pleas and Speaker of the House of Lords. Atkyns criticizes Edward Herbert's decision in the case of Edward Hales. In that case, James II overturned the penal laws in favor of Hales. Hales was a Roman Catholic and would not swear an oath upon entering the military.
